Guidelines: Marie’s Vineyard Architectural Control Committee (ACC)
Overview: The Covenants of the Maries Vineyard Homeowners Association have defined language under Article V pertaining to the Architectural Control Committee (ACC). A recent review by our attorney Gregory Eklund determined that for this to be enforceable, all work on a home that is covered under the scope of Article V must be submitted to the ACC for approval, REGARDLESS OF HOW INSIGINIFICANT IT MAY BE. Per our attorney, the ACC covenant must be uniform in its application. As an example, this legal review requires that even if one paints their house the same color as the house was originally painted, a request must be sent to the ACC and approval received before such work can commence. For Maries Vineyard to have the ability to maintain the ambiance and value of our community, all work performed in accordance with the Covenants must be handled in a standardized manner.
Purpose: The ACC’s job is to review all Homeowners Association (HOA) member plans for changes, additions, and modifications to their properties. The ACC is empowered in accordance with our CCRs to approve, disapprove, or return for modifications any plan for property alterations, including but not limited to:
· Structure modifications (e.g., additional skylights, doors, windows, room additions, etc.).
· Fences (materials, placement, height, color, etc.).
· New front yard landscaping (rain gardens, Xeriscaping, native plant gardens, etc.).
· Exterior paint & trim.
· Paving and surfaces.
· Front/Backyard additions visible from the street/sidewalks (gazebos, hot tubs, firepits, etc.).
Selection Process: At the HOA Board’s option, the ACC will be appointed from homeowners, current board members, or both. Alternatively, the Board may choose to operate as a committee of the whole for ACC purposes.
Guidance for HOA members: Please submit all plans to the ACC for review via U.S. mail to Maries Vineyard HOA, 2020 Craig Road SE, Olympia WA 98501. Plans should be sufficiently detailed to allow for full evaluation, and should include all dimensions, color samples (including roof colors if reroofing) and detailed explanations of work to be performed.
When planning your schedule, please allow for the full 30-day ACC review period.
The ACC will provide you with an acknowledgement of receipt.
You will be contacted by the ACC with its decision to approve, disapprove or request changes to your plans within 30 days of submission. If you have not been contacted by the ACC within the 30-day review period, you may execute your plans without modification.
Failure to Comply: The Board of Maries Vineyard HOA reserves the right for establishing fines, penalties, legal fees and collection costs for any case of non-compliance.
